Terms of Service

Welcome to Rate The Fit. These Terms of Service ("Terms") are an agreement between you and Rate The Fit ("we", "us") that governs your use of the Rate The Fit iOS application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What the Service is
Rate The Fit lets you photograph or upload a picture of your outfit and receive an automated style rating: a numeric score, a short written verdict and commentary, and up to three styling suggestions, each of which may include an AI-generated image showing the suggested change applied to your outfit. Your ratings are saved to your looks history so you can revisit them.
2. AI-generated content
Ratings, commentary, suggestions, and suggestion images are produced by artificial intelligence. They are opinions generated by a machine, offered for entertainment and inspiration only. They may be inaccurate, incomplete, or inconsistent, and they are not professional, medical, or psychological advice of any kind. Generated images are illustrative renderings; they are not photographs of real products, and any resemblance to real garments or brands is coincidental. You are responsible for how you use the suggestions. We design the Service to comment only on clothing and styling, never on bodies or appearance, but we cannot guarantee every output will be perfect. If an output seems wrong or hurtful, contact us and we will look into it.
3. Your account
You may use one free rating without an account. To keep your history and receive additional ratings you must create an account with your mobile phone number: we text you a six-digit code to verify it, so there is no password to choose or remember. You are responsible for keeping access to your phone number secure and for all activity under your account. You must be at least 13 years old (or the minimum age in your country) to use the Service.
4. Text messages
We sign you in by text message. When you enter your mobile number and tap "Text me a code", you are asking us to send you a one-time verification code and consenting to receive that message. This is the only kind of text we send. We never send marketing, promotional, or recurring messages.
— Message frequency: one message per sign-in attempt, and only when you request it.
— Message and data rates may apply, depending on your mobile plan.
— Reply STOP to any message to opt out, or HELP for help. Opting out means you can no longer sign in by text; contact hello@ratethe.fit if you need another way in.
— We do not share or sell mobile phone numbers, or your consent to receive text messages, with third parties for marketing purposes. Your number is shared only with the providers that deliver the message.
Delivery depends on your mobile carrier and is not guaranteed.
5. Your content
You keep ownership of the photos you upload. By uploading a photo you grant us a limited license to store, process, and transmit it solely to operate the Service: generating your rating and suggestion images, showing your looks history back to you, maintaining backups, and, if you choose to share a look, publishing that look at the share link you create.
Sharing is always your choice. Looks are private until you tap Share. Sharing creates a link at an unguessable address that shows that look's photo, score, and commentary to anyone who opens it, with no account required. Only share looks you are comfortable making visible to whoever receives the link. Deleting your account removes shared looks along with everything else. You promise that you have the right to upload each photo, that it depicts you or someone who has given you permission, and that it contains nothing unlawful. Do not upload photos of minors other than yourself. We may remove content that violates these Terms.
6. Subscriptions and billing
Rate The Fit Plus includes up to 75 ratings per UTC calendar month while your subscription is trialing or active. Unused ratings do not roll over. New subscribers receive a 30-day free trial and must provide a valid payment method when starting it. Unless you cancel before the trial ends, the subscription automatically converts to $2.99 per month and renews monthly. The free trial is available once per account; restarting a canceled subscription is billed immediately. Payment is processed by Stripe; we do not store your card details. You can cancel at any time from Settings via Manage Subscription; cancellation takes effect at the end of the current trial or billing period and you keep access until then. Free credits (one anonymous rating per device and one signup credit per verified account) are promotional and may not be exchanged for cash. Except where required by law, payments are non-refundable.
7. Fair use
You agree not to misuse the Service, including: reverse engineering it, using it to harass or demean anyone, uploading unlawful or infringing content, probing or disrupting our infrastructure, reselling access, or using automated tools to exceed your rating quota. We may suspend or terminate accounts that break these rules.
8. Deleting your account
You can delete your account at any time from Settings. Deletion permanently removes your account, your ratings, your uploaded and generated images, and cancels any active subscription. This cannot be undone.
9. Disclaimers and liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose, or $50 if you paid nothing.
10. Changes
We may update the Service and these Terms. If we make material changes we will notify you in the app; continued use after changes take effect means you accept them. If any part of these Terms is found unenforceable, the rest remains in effect.
11. Apple App Store
If you obtained the app from the Apple App Store, the following also applies:
— These Terms are between you and Rate The Fit only, not Apple. Apple is not responsible for the app or its content.
— Apple has no obligation to provide maintenance or support for the app.
— If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
— Apple is not responsible for addressing any claim you or a third party has relating to the app, including product liability, failure to conform to a legal requirement, consumer protection, and intellectual property claims.
— You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
— Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
